Can car dealer cash a deposit if the deal did not go through?

My husband put a down payment on a car, the finances did not go through. They told him about not being able to get the car on Tuesday, but on Monday they cash the check (with out us knowing) they gave him back the check as they lead him to beleive was but a copy of. Now our account is in overdraft.

A lot of dealerships will cash a deposit check before they get a reply from the lender. It is not illegal and you are entitled to the amount in full. Since you wrote a check, some dealerships will wait until the check has cleared, then issue you a check back for the deposit.

Cash deposits are usually always returned much quicker. There is no reason to get a lawyer if you signed the check because the dealership would simply prove that you consented to the funds transfer, even if you didn’t . You can try to go to your bank and do a stop pay, however many charge for the service. Good Luck!

In CA, car deal fell through. Dealer sold my trade-in, wants new car back and will only refund my $500 down.??

So, what should I do with the new car? I have a contract that spells out monthly payments but the dealer says they couldn’t obtain financing. They wanted me to sign a new contract for $200 per month more. I said no. They want the new car back but said they sold my trade-in and can only give me back my $500 cash down. I will end up with no car. Should I hold firm on the contract? Not return the car? My trade-in still has money owed to a bank. Comments.

I say if you signed the contract stick to it. Just make sure there is no clause in it that cancels it if the situation you are in now occurs. As far as selling your trade in and giving you $500, that is seriously some BS. HOWEVER, make sure that, once again, your contract doesn’t make it OK for them to screw you over like that.

Who is giving the best deals for new cars right now?

My husband and I are in the market for a new car, he has A+++ credit, mine is not so good averages about a C- :(
Anyhow, we are thinking of going the new car route since there are so many great 0% interest deals and cash back deals.
But who would you say has the best offers?

We are not in the market for a high end luxury car btw. Something less than $15,000, we are manual drivers and we don’t need lots of extras.

Toyota. With all the recent safety recalls of Toyota vehicles the company has suffered a huge public relations snafu. They are willing to almost give cars away just to move them off the dealerships lots.

However if your safety is a consideration the best selling cars currently are built by Ford.
